About False Advertising Class Actions
State and federal false laws prohibit various types of deceptive advertising, misleading labeling, and similar deceptive practices. False advertising laws provide important rights for consumers, arming them with the ability to seek monetary damages when they’ve been misled. False advertisers often operate on a massive scale, leading consumers to pay higher prices for products.
There are numerous types of false advertising practices that companies use against consumers. These can include:
- bait-and-switch ads
- false or misleading labels
- failing to disclose material information
- falsely portraying a product as superior to that of another company
- confusion regarding the identity of a product, seller, or manufacturer
- misleading or confusing information about a product’s cost
- failing to disclose extra costs associated with a product’s purchase or communicating those costs in a confusing way
One type of false advertising claim is a “fake discount scheme” where a company advertises a product as a discount when the product is in fact being sold at its regular price in an attempt to lure consumers into purchasing the product. Fake discounts are a common tactic used by retailers to influence consumers to make purchases. This practice is also referred to as “false reference pricing.” The idea is that the customer will see a sales price next to a higher regular price and be more likely to buy the item because it is on sale.
Other examples of false advertising include “greenwashing,” where a company makes false claims about the recyclability, biodegradable, or eco-friendly; and hidden fees that cause a product to cost more for all consumers than the price advertised.
Companies that use these deceptive marketing tactics to deceive consumers into thinking that they are purchasing a product at a better price can be liable for their fraudulent and misleading advertising practices.
