History of Gardasil®
The Gardasil® vaccine was created to prevent individuals from contracting the sexually transmitted human papillomavirus, commonly known as “HPV”. HPV has the potential to cause a host of problems including genital warts, increased risk of certain cancers, and abnormal pap smears. Additionally, once HPV is contracted, the infected individual carries the virus and is capable of spreading it to others. Many people are not aware that they have HPV, and most people will never develop symptoms or health problems from it.
Currently Gardasil® is approved for men and women between the ages of nine and 45 years old, but it is most commonly marketed to adolescents and their parents and caregivers. HPV is one of the most common sexually transmitted infections.
In 2006, the drug company, Merck & Company (“Merck”), received approval from the Food and Drug Administration (“FDA”) to provide the HPV vaccine to the general public. It quickly became clear that the data used to support the approval by the FDA was concerning. Many individuals who received the vaccine have experienced the following side effects and injuries including but not limited to:
- Auto-immune disorders
- Chronic fatigue syndromes (“CFS”)
- Chronic inflammatory demyelinating polyneuropathy (“CIDP”)
- Chronic pain syndromes
- Chronic regional pain syndrome (“CRPS”)
- Death
- Dysautonomia
- Fibromyalgia
- Guillain-Barre Syndrome
- Lupus
- Movement disorders
- Multiple Sclerosis
- Neurological disorders
- Premature ovarian failure
- Postural orthostatic tachycardia syndrome (“POTS”)
- Reproductive disorders
- Small fiber neuropathy
Many of the side effects and injuries caused by the Gardasil® vaccine are far more devastating conditions than HPV!
Many of these possible side effects were not included on the Gardasil® prescribing information. Therefore, individuals who opted to receive the Gardasil® vaccine were not informed of the many and serious potential side effects prior to consenting to the vaccine for themselves or their children.
It is alleged that during the clinical trials, Merck mischaracterized reported side effects as new medical conditions, unrelated to Gardasil®, when individuals reported their side effects from Gardasil®. By doing this, these “new medical conditions” were not considered side effects related to Gardasil®, and they were not included in the prescribing information, nor were the dangers of developing these conditions relayed to patients. Additionally, Merck allegedly failed to follow-up with participants that experienced side effects and failed to tell study participants that the placebo was infused with a neurotoxin.
Over the last 22 years, the formulation of Gardasil® has been revised, and the vaccine has been marketed as Gardasil®, Gardasil 4®, and Gardasil 9®. Regardless of which version an individual received, the most important consideration when deciding to file a lawsuit is the statute of limitations. In order to have a viable Gardasil® claim, a petition must be filed within three years of the onset of the first side effect symptoms.
There are many lawsuits pending against Merck alleging misrepresentation of the efficacy of the vaccine and fraudulent marketing practices. This litigation is ongoing and individuals must act quickly to preserve their rights!
Are you eligible to file a claim?
In order to be eligible to file a claim, the following criteria must apply:
-The Gardasil® vaccine must have caused a serious injury to you or a family member. Legal guardians may be eligible to file a claim on behalf of an injured individual.
-Your injury or your family member’s injury from the Gardasil® vaccine must have lasted at least six months or required surgery and hospitalization or resulted in death.
-The Statute of Limitations, meaning the time limit to file a claim for injury after you, or a family member received the Gardasil® vaccine, is three years from the date an individual first began experiencing symptoms from the Gardasil® vaccine. In the tragic event that a death occurred, the statute of limitations is two years from the date of the death.
