The Illinois Biometric Information Privacy Act limits how companies within the state are allowed to capture and store the personal biometric information of consumers. Companies doing business within Illinois specifically are not allowed to collect biometric data of Illinois residents without the explicit consent of the individual.
About Airbnb, Inc. and the Potential Legal Violation
Airbnb is a platform where hosts who have spaces they are willing to open up to travelers connect with people looking for accommodations. Instead of staying in a hotel, guests can stay in a comfortable, home-like setting while they are on vacation or have business out of town. Founded only 12 years ago, Airbnb currently has 20% of the market share for online reservations. As part of their identity verification, users of their platform are asked to upload facial photos. In using these photos for verification, Airbnb may have violated the Biometric Information Privacy Act.
